The High Court of South Africa rejected requests for a judicial review concerning the National Energy Regulator of South Africa’s (Nersa) decision on Eskom’s fifth MultiYear Price Determination (MYPD5) application for the fiscal years 2023/24 and 2024/25, as reported by Business Tech.

Both the Democratic Alliance (DA) and the South African Local Government Association (Salga) sought a review of Nersa’s decision, but the court ruled in favour of Nersa, concluding that the national energy regulator had thoroughly considered all relevant factors and that its decisions were neither arbitrary nor irrational.

According to independent energy analyst Pieter Jordaan, the tariff increase will be implemented despite Eskom’s failure to meet key conditions outlined by Nersa as part of its MYPD5.

An increase of 12.74% is set to take effect in April.
